hereinafter referred to as “reset sports”, “we”, “us” or the “Seller”.
Our online shop is intended exclusively for consumers.
A “consumer” within the meaning of Section 13 of the German Civil Code (Bürgerliches Gesetzbuch – BGB) is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession.
Orders placed by entrepreneurs acting in the course of their commercial or independent professional activity are not accepted through this online shop.
2. Conclusion of Contract
The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.
Customers may place products in their shopping cart and review and correct their entries at any time before submitting their binding order using the functions provided during the checkout process.
By clicking the button used to submit the order, the customer places a binding order for the products contained in the shopping cart.
After the order has been submitted, the customer will receive an order confirmation by email. The specific point at which the purchase agreement is concluded depends on the payment method selected and the information provided during the checkout process.
The contract language is German or English, depending on the language selected by the customer.
3. Right of Withdrawal
Consumers generally have a statutory right of withdrawal when entering into distance contracts.
Detailed information regarding the right of withdrawal, the applicable withdrawal period, the procedure for exercising the right of withdrawal and applicable exclusions can be found in our separate Right of Withdrawal policy.
The statutory right of withdrawal does not apply where an exclusion provided for by law applies. In particular, it does not apply to goods that are not prefabricated and for the production of which an individual choice or specification by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs.
4. Prices and Payment
All prices displayed in our online shop are final prices and include statutory German VAT where applicable.
Any additional shipping costs are displayed separately during the checkout process before the customer submits the order.
For deliveries outside Germany, additional taxes, customs duties, import duties or other charges may be imposed by the competent authorities. Unless expressly stated otherwise, such charges are not included in the product or shipping price and must be borne by the customer.
The payment methods currently available are displayed during checkout.
Depending on the selected payment method, payment may be processed by an external payment service provider. Additional terms and conditions of the respective payment provider may apply.
Invoices, credit notes and other communications relating to an order may be provided electronically, in particular by email.
5. Delivery and Shipping
Delivery will be made to the delivery address specified by the customer during the ordering process unless otherwise agreed.
Available shipping methods, shipping costs and estimated delivery times are displayed in the online shop or during checkout.
If delivery cannot be completed because the customer has provided an incorrect or incomplete delivery address, or for another reason for which the customer is responsible, the customer may be required to bear the reasonable additional costs of a new delivery, to the extent permitted by law.
This does not affect the customer’s statutory rights, including any applicable right of withdrawal.
If an ordered product is unexpectedly unavailable, Reset Sports will inform the customer without undue delay. Any payments already made for unavailable products will be refunded.
Delivery times for individually manufactured or customised products may differ from those applicable to standard products. Any relevant production or delivery times communicated on the respective product page, in an individual offer or during the ordering process shall apply.
6. Transfer of Risk
The risk of accidental loss or accidental deterioration of the goods passes to the customer when the goods are delivered to the customer or to a third party designated by the customer.
Where the customer independently commissions a carrier who was not previously proposed by Reset Sports, the statutory provisions regarding the transfer of risk apply.
7. Retention of Title
The goods remain the property of Reset Sports until payment has been made in full.
8. Warranty and Defects
The statutory warranty rights under German law apply.
If delivered goods are defective, customers are entitled to the statutory remedies available under German law.
Customers are requested to inspect delivered goods for obvious transport damage upon receipt and, where possible, to notify both the carrier and Reset Sports of any such damage.
Failure to make such a notification does not affect the customer’s statutory warranty rights.
In the case of customised products, minor deviations in colour, positioning, dimensions or appearance that are technically unavoidable or customary in the relevant production process do not constitute a defect, provided that the product remains suitable for its intended purpose and the deviation is reasonable for the customer.
9. Customer-Supplied Designs, Logos and Other Content
Where customers provide Reset Sports with logos, graphics, trademarks, names, images, text or other content for the manufacture or customisation of products, the customer is responsible for ensuring that they have the necessary rights to use such content.
The customer must ensure that the use of the supplied content for the requested product does not infringe any third-party rights, including copyrights, trademark rights, design rights or other intellectual property rights.
Reset Sports reserves the right to reject orders containing content that is unlawful or that we reasonably believe may infringe third-party rights.
10. Liability
Reset Sports shall have unlimited liability for damages caused intentionally or by gross negligence by Reset Sports, its legal representatives or agents.
Reset Sports shall also have unlimited liability in the event of injury to life, body or health, where a guarantee has been expressly given, and where liability arises under the German Product Liability Act (Produkthaftungsgesetz).
In the event of a slightly negligent breach of a material contractual obligation, liability shall be limited to the foreseeable damage typical for this type of contract.
Material contractual obligations are obligations whose fulfilment is essential for the proper performance of the contract and on whose fulfilment the customer may regularly rely.
To the extent permitted by law, liability for other damage caused by slight negligence is excluded.
11. Data Required for Order Fulfilment
To fulfil orders, Reset Sports may transmit the personal data necessary for delivery to shipping providers, fulfilment partners or other service providers involved in processing the order.
Payment information may be transmitted to the payment service provider or financial institution selected by the customer where necessary to process the payment.
Further information regarding the processing of personal data can be found in our Privacy Policy.
12. Consumer Dispute Resolution
Reset Sports is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless otherwise required by law.
13. Governing Law
The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
This choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the
